Course Description

Aim of the course is to review the main issues related to fair juvenile trials, with particular attention, inter alia, to the current problems related to the challenges of immigration, health emergencies, unaccompanied minors and remote hearings. A specific focus will be reserved to the procedure of entrusting minors to family-homes and communities, to the time required, to the methods of verifying whether the reasons for their placement remain and also to the competence of the periodical surveillance functions. Specific attention, in the criminal sector, will be devoted to the principles of adequacy, minimum offensiveness and irrelevance of the fact, with a particular focus on the application practices relating to the probation of minors and adults involved in sexual crimes or in organized crime contexts. Finally, the main issues relating to family and child law in the jurisprudence of the European Court of Human Right will be pointed out.
